Acceptable Use Policy

1. Purpose and scope
This Acceptable Use Policy (the "AUP") governs how you may use Perl, operated by Retirement Plan Specialists, Inc. d/b/a Turner Pension Solutions ("TPS," "we"). It is part of, and incorporated into, the Perl Terms of Service. Capitalized terms have the meanings given there.
This AUP exists for three reasons. It protects the Service and other customers from abuse. It protects our access to the underlying public data sources, which we depend on. And it keeps you — and us — on the right side of the laws that govern how professionals may market to, and make decisions about, other businesses and the people in them.
You are responsible for your own compliance and for that of your Authorized Users.
2. What the Service is for
Perl is licensed for use by retirement-plan, financial-advisory, accounting, and employee-benefits professionals to:
- research retirement plans, plan sponsors, and service-provider arrangements using public filing data;
- identify and evaluate prospective clients within a territory, industry, plan-size band, or provider relationship;
- prepare for client and prospect conversations, and produce internal analyses and client-facing deliverables that incorporate specific findings; and
- support their own professional judgment with sourced, verifiable information.
Anything materially outside that is likely outside your license. If you are unsure whether an intended use is permitted, ask us at perl@wehelppeopleretire.com before you build a process around it. We would rather answer the question than enforce this policy.
3. Account integrity
You may not:
a. share your sign-in link, session, or account with anyone, including colleagues at your own firm who are not named Authorized Users on your Subscription; b. create an account using a false identity, another person's identity, or an email address you are not authorized to use; c. provide false or materially incomplete information in an access request, including about your firm or professional role; d. maintain multiple accounts to circumvent seat limits, rate limits, plan entitlements, trial terms, or a prior suspension or termination; or e. resell, sublicense, rent, lend, time-share, or provide access to the Service to any third party, or operate it as a service bureau or on any other resale or agency basis for others.
On seat sharing specifically. We know this is the most commonly rationalized breach in professional software, and we would rather be direct than coy about it: one account is one person. If you need access for your team, tell us and we will price it. If we detect concurrent use from patterns inconsistent with a single user, we may require the account to be brought into compliance and may suspend access in the meantime.
4. Volume, automation, and technical limits
You may not:
a. exceed the rate, volume, query, export, or seat limits of your plan, or use any method to evade them; b. access the Service by any automated means — scraper, crawler, bot, headless browser, script, or unauthorized integration — other than an interface we expressly provide for that purpose; c. use the Service to systematically extract, copy, or accumulate its data in bulk, whether by automation or by repeated manual export, for the purpose described in Section 5; d. interfere with or place undue load on the Service or its infrastructure, or attempt to degrade the Service for others; or e. circumvent, disable, or interfere with any security feature, authentication mechanism, rate limit, entitlement check, or usage measurement.
Fair use. Normal professional research produces bursts of activity, and we do not intend this section to penalize a busy week. It is directed at sustained, systematic extraction and at automation that displaces interactive use.
5. Data redistribution and competitive use
You may not:
a. resell, license, publish, syndicate, distribute, or make available the Service's data or Output as a dataset, database, data feed, list product, directory, or API; b. use the Service, its data, or its Output to create, train, benchmark, evaluate, or improve any product, dataset, model, or service that competes with the Service; c. use the Service, its data, or its Output to train or fine-tune any machine-learning model, or to generate synthetic data for that purpose; d. accumulate exports for the purpose of reconstituting a substantial part of the Service's database outside the Service; or e. remove, alter, or obscure any citation, source reference, attribution, watermark, disclaimer, or notice that accompanies Output.
What is expressly allowed. Using specific findings in an ordinary client-facing deliverable — a prospect summary, a proposal, a plan review, a meeting-prep memo, a marketing piece grounded in sourced facts — is the intended use of the Service and is permitted. The line this section draws is between using the information and becoming a distributor of the data.
6. Outreach and marketing conducted with information from the Service
Perl helps you find prospects. How you contact them is entirely your responsibility, and it is governed by law we cannot comply with on your behalf. You may not use the Service, or information obtained from it, to conduct outreach that violates:
a. the Telephone Consumer Protection Act and its implementing rules, including restrictions on autodialed and prerecorded calls, on text messages, and on calls to numbers on the National Do-Not-Call Registry or an internal do-not-call list, and applicable consent requirements; b. the FTC's Telemarketing Sales Rule or any state telemarketing, do-not-call, or caller-ID statute (Florida's own telephone-solicitation law among them); c. the CAN-SPAM Act, including its requirements for accurate headers and subject lines, a valid physical postal address, a functioning opt-out, and prompt honoring of opt-outs; d. any state law governing unsolicited commercial email, text messaging, or fax; e. the advertising, communications, testimonial, endorsement, recordkeeping, and supervision rules of any regulator or self-regulatory organization with authority over you — including, as applicable, SEC and FINRA rules and your firm's own compliance policies; or f. any applicable anti-harassment or unfair-and-deceptive-practices law.
You may not represent, expressly or by implication, that TPS or Perl endorses you, has vetted the plan or sponsor you are contacting, or has any relationship with the recipient of your outreach.
7. Prohibited decision-making uses
We are not a consumer reporting agency and Perl is not a consumer report. You may not use the Service or any Output, in whole or in part, as a factor in determining any individual's eligibility for:
a. credit or insurance; b. employment, promotion, reassignment, or retention; c. housing or tenancy; d. a government license or benefit; or e. any other purpose regulated by the Fair Credit Reporting Act or any comparable state law.
You also may not use the Service or Output to discriminate against any person or business on a basis prohibited by law, or to make or support decisions about individuals in a manner that a reasonable professional would recognize as outside the Service's purpose.
8. Misuse of Output
You may not:
a. present Output as verified fact without the independent verification the Terms of Service require, or represent that TPS has verified it; b. present Output as investment, tax, legal, accounting, actuarial, or fiduciary advice, or as advice from TPS; c. characterize a plan, sponsor, or service provider as non-compliant, imprudent, overpriced, mismanaged, or in breach of any duty on the basis of Output alone, or state such a conclusion to a third party as though it were established; d. attribute a statement to TPS or Perl that it did not make, or alter Output and continue to attribute it to us; or e. use Output in a communication to a plan sponsor, participant, or the public without confirming the underlying filing facts and applying your own professional judgment.
Why (c) is here and matters. Public filing data is genuinely useful for identifying what is worth asking about, and genuinely insufficient for concluding what is wrong. A high fee ratio in a filing may reflect a bundled arrangement, an unusual plan year, or a filer's reporting choice. Presenting an inference from a filing as a finding about someone's plan exposes you — and potentially us — to a defamation or unfair-practices claim, and it is also just bad professional practice.
9. Security and integrity
You may not:
a. probe, scan, or test the vulnerability of the Service or any related system, or breach or circumvent any security or authentication measure, without our prior written permission; b. reverse engineer, decompile, or disassemble the Service, or attempt to discover its source code, underlying models, system prompts, database schema, or trade secrets, except to the extent that restriction is unenforceable under applicable law; c. attempt to extract, reconstruct, or elicit the Service's system instructions, prompts, or internal configuration, or to induce the assistant to disregard its instructions or safety constraints; d. attempt to cause the assistant to execute database operations other than reads, or to access data outside your entitlements; e. introduce malware, or content designed to disrupt, damage, or gain unauthorized access to any system; f. use the Service to violate any law, or to store or transmit unlawful content; or g. access another customer's account, data, or saved work.
Reporting a vulnerability. If you find a security issue, please tell us at perl@wehelppeopleretire.com rather than testing its limits. We will not pursue action against good-faith research that is promptly reported, does not access other customers' data, and does not degrade the Service.
10. Content you submit
You may not submit to the Service:
a. any individual's Social Security number, financial-account number, government-identification number, health information, or precise geolocation; b. participant-level retirement-plan data or other personal information about plan participants; c. information you are contractually or legally prohibited from disclosing, including another party's confidential information or material non-public information; or d. content that is unlawful, infringing, defamatory, harassing, or that you lack the right to submit.
11. Enforcement
We may investigate suspected violations and may, at our discretion and with or without notice:
- warn you, or ask you to bring your use into compliance;
- throttle, limit, or queue your requests;
- disable a feature, export capability, or Authorized User seat;
- suspend the account; or
- terminate the Subscription under Terms of Service §13.3.
We will generally start with the least disruptive step and give you a chance to cure, except where a violation is willful, is causing ongoing harm, threatens the security or integrity of the Service or its data sources, or exposes us to legal risk. Where a violation causes us loss, Terms of Service §15 applies.
Suspension or termination for a violation of this AUP does not entitle you to a refund.
12. Changes
We may update this AUP as the Service and the applicable law evolve, with notice as provided in the Terms of Service. The current version is always at https://app.tps5500.com/legal/acceptable-use.
